FAR 91.1014 Management Specifications

FAR 91.1014 explains how fractional ownership program managers apply for management specifications and the criteria the FAA uses to issue or deny them.

In Plain English

FAR 91.1014 sets out how a fractional ownership program manager gets (or is denied) management specifications — the FAA-issued document that authorizes the program to operate under Subpart K.

To apply, the program manager must submit an application:

  • In the form and manner prescribed by the Administrator, and
  • Containing any information the Administrator requires.

The FAA will issue management specifications to the program manager (on behalf of the fractional owners) if, after investigation, it finds the applicant:

  • Meets the applicable requirements of Subpart K, and
  • Is properly and adequately equipped under this chapter and able to conduct safe operations under Part 91 and the management specifications.

Conversely, the FAA will deny the application if it finds the applicant is not properly or adequately equipped, or cannot conduct safe operations under Part 91.

Operationally, this is the gateway rule: without approved management specifications, a fractional program cannot legally operate under Subpart K, so demonstrating capability and safe-operation readiness during the application process is essential.
