FAR 91.1019 — Tests and Inspections
FAR 91.1019 lets the FAA inspect fractional ownership program managers anytime to verify compliance with management specs, regs, and recordkeeping requirements.
FAR 91.1019 gives the Administrator (FAA) broad authority to inspect or test a fractional ownership program manager at any time or place to verify compliance with Title 49 of the U.S. Code, applicable regulations, and the program manager's management specifications. Note: this rule covers all inspections except en route inspections.
The program manager must:
- Make the management specifications available at the principal base of operations (or another FAA-approved location).
- Allow the FAA to perform any test or inspection (other than en route) to verify compliance.
- Ensure employees and contractors responsible for required records make those records available to the Administrator.
The FAA may use these inspections — or any other appropriate grounds — to determine whether the program manager remains eligible to hold its management specifications. If the program manager fails to produce its management specs, records, documents, or reports on request, the FAA can suspend all or part of the management specifications. Operationally, this rule keeps fractional operations transparent and accountable to FAA oversight at all times.
