CAMP Records Transfer

FAR 91.1441 CAMP Records Transfer

FAR 91.1441 explains how fractional ownership program managers must transfer CAMP maintenance records to a purchaser when an aircraft leaves the program.

In Plain English

FAR 91.1441 governs what happens to maintenance records when a U.S.-registered fractional ownership program aircraft maintained under a Continuous Airworthiness Maintenance Program (CAMP) is removed from the program manager's management specifications and sold.

At the time of sale, the program manager must transfer the aircraft's maintenance records to the purchaser, either in plain language or in a coded form acceptable to the Administrator. Specifically, the program manager must hand over:

  • The records described in § 91.1439(a)(2) (current status-type records).
  • The records described in § 91.1439(a)(1) that aren't already covered above (historical maintenance records).

For the historical records, the purchaser may allow the program manager to retain physical custody. However, even if the program manager keeps them, the purchaser is still responsible under § 91.1439(c) for making those records available for inspection by the FAA Administrator or the NTSB.

This matters operationally because it ensures continuity of airworthiness documentation when an aircraft transitions out of a fractional CAMP program — protecting both the new owner and regulatory oversight.

Regulation Text
14 CFR § 91.1441
§ 91.1441 CAMP: Transfer of maintenance records. When a U.S.-registered fractional ownership program aircraft maintained under a CAMP is removed from the list of program aircraft in the management specifications, the program manager must transfer to the purchaser, at the time of the sale, the following records of that aircraft, in plain language form or in coded form that provides for the preservation and retrieval of information in a manner acceptable to the Administrator: (a) The records specified in § 91.1439(a)(2). (b) The records specified in § 91.1439(a)(1) that are not included in the records covered by paragraph (a) of this section, except that the purchaser may allow the program manager to keep physical custody of such records. However, custody of records by the program manager does not relieve the purchaser of its responsibility under § 91.1439(c) to make the records available for inspection by the Administrator or any representative of the National Transportation Safety Board.
Oral Exam Questions a DPE Might Ask
Q1When a fractional ownership aircraft is removed from a CAMP program and sold, what records must the program manager transfer to the purchaser?
Per FAR 91.1441, the program manager must transfer the records specified in § 91.1439(a)(2), plus any § 91.1439(a)(1) records not already covered, in plain language or in an acceptable coded form.
Q2Can the program manager keep physical custody of any maintenance records after the aircraft is sold?
Yes. Under FAR 91.1441(b), the purchaser may allow the program manager to retain custody of the § 91.1439(a)(1) historical records, but this does not relieve the purchaser of responsibility for them.
Q3If the program manager retains custody of the records, who is responsible for making them available to the FAA or NTSB?
The purchaser remains responsible. FAR 91.1441 specifies that custody by the program manager does not relieve the purchaser of its duty under § 91.1439(c) to make records available to the Administrator or NTSB.
